Welcome to https://paintby.ai (the "Site"). These Terms and Conditions ("Terms") govern your use of our website and services, including the ordering and delivery of custom paint-by-numbers kits generated from user-uploaded or AI-created images. By accessing our Site or placing an order, you agree to be bound by these Terms.

2. Products

We sell custom paint-by-numbers kits based on images generated or uploaded by you. Each product is made to order based on your unique input, including image, canvas size, and paint color complexity.

3. Ordering Process

To place an order:

  • Upload or generate your image using our online tool
  • Select your preferred canvas size and number of paint colors
  • Confirm the image preview and custom selections
  • Complete checkout using Stripe

Once the order is placed, we immediately begin processing and manufacturing your custom kit, which is why changes or cancellations are not possible after payment.

4. Pricing and Payment

All prices are displayed in your selected currency and include VAT where applicable. Payments are securely processed through Stripe. We do not store your payment information.

5. Shipping and Delivery

  • Production begins after payment and typically takes up to 3 business days (handling time)
  • Shipping takes approximately 5 to 20 days, depending on your location
  • We are not liable for delays caused by customs, carriers, or force majeure events
  • You will receive a tracking link once your order ships

6. Returns and Refunds

Since each kit is custom-made based on your design, we do not accept returns or offer refunds.

Exception: If your item arrives damaged or defective, please contact us within 7 days of delivery at [email protected] with photos and a description of the issue. We’ll send a replacement free of charge.

7. Customer Responsibilities

By submitting an image for generation, you confirm that:

  • You have the rights to use the image (e.g., no copyrighted or offensive content)
  • You understand the image will be converted into a simplified paint-by-numbers version

We reserve the right to cancel orders containing images we deem inappropriate or infringing.

8. Limitation of Liability

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Losses due to incorrect shipping info provided by you
  • Any third-party errors (e.g., shipping carrier delays)

Our total liability shall not exceed the price you paid for the product.

9. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect and use your information.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes implies acceptance.
